Terms & Conditions

These Terms and Conditions govern access to and use of the Site (as defined below), courses, applications, content, and related products and services made available by Care Solutions Training, a division of Care Solutions Incorporated (“Care Solutions Training,” “we,” “us,” or “our”).

The website consists of all pages contained at the domain www.caresolutionstraining.com and any related online platforms made available by Care Solutions Training (collectively, the “Site”). Care Solutions Training does not accept or hold responsibility for any sites linking to the Site or linked from the Site but hosted outside the domain www.caresolutionstraining.com.

Section 01

Definitions

• “Product” means any product, course, Subscription, content, or other offering made available for purchase or access by Care Solutions Training.
• “User” means any individual or entity that accesses the Site, creates an account, orders a Product, accesses a Product, or signs a contract with Care Solutions Training to allow any entity or entities to order or access courses via the Site.
• “Subscription” means a Product available for purchase by individuals or groups that provides access to designated online courses for a period of one year from the date the subscription is purchased.

Section 02

Hours of Operation

Care Solutions Training seeks to provide continuous access to the Site and the Products. However, Care Solutions Training does not provide any representations or warranties regarding the availability of the Site or the Products and shall not be liable for any downtime. Care Solutions Training will make reasonable efforts to alert Users about planned or unplanned outages by posting a notification on the Site.

Section 03

User Accounts; User-Generated Content

Care Solutions Training Users must have individual accounts with a valid, unique email address. Courses and tests must be completed in the language the User selected when ordering the course. Accounts cannot be transferred between individuals, and Products cannot be shared or transferred between accounts.

Accounts may be deleted or disabled by Care Solutions Training for violation of these Terms and Conditions, in Care Solutions Training’s sole discretion, at any time without prior notice and without refunds for any previously purchased Products.

By submitting User-generated content (including feedback), each User grants Care Solutions Training a worldwide, non-exclusive, transferable, fully paid-up, royalty-free license to host, display, reproduce, distribute, and otherwise exploit such content in any media formats and through any media channels. Users are solely responsible for the contents of any User-generated content and shall retain ownership thereof.

Section 04

Professional Development Certificates

Certificates for successful coursework completion issued by Care Solutions Training are official only if they are printed directly from the Site, signed by the User named on the certificate, and unaltered. Certificates are issued in the language the User selected when ordering the course. Care Solutions Training certificates may not be reproduced, shared, or transferred.

In the event of any dispute over certificate authenticity, the determination of Care Solutions Training is final. Professional development credits are subject to acceptance criteria by the applicable accrediting or regulatory authority. Each User is responsible for confirming eligibility to receive credit before purchasing any course.

Section 05

Privacy

Your access and use of our Site is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference. Please review the Privacy Policy carefully to understand how we collect, use, disclose, and otherwise process personal information.

Section 06

Group Subscription Users

Administrators of a group Subscription will have access to User course certificates and records of courses completed within that Subscription, consistent with our Privacy Policy.

Section 07

Refund Policy

By ordering any Product from Care Solutions Training, you agree to the following refund policy:

• There are no substitutions or exchanges for purchased Products.
• Refund requests must be made by the User and acknowledged by Care Solutions Training in writing within 30 days of the order date. Refunds will not be issued if payment was processed more than 30 days before the date of the refund request.
• The following Products are not eligible for refunds:
  • Products for which a User has accessed any portion of the Product, including any course slides
  • Products ordered using a coupon number associated with that Product
  • Products not purchased directly from Care Solutions Training

If a User is eligible for a refund, Care Solutions Training will refund the price paid for the Product, minus a 15% service charge, within 10 days of acknowledging the request.

Care Solutions Training makes no representations or warranties regarding refunds for hosted courses where payment was not processed by Care Solutions Training or its affiliated payment processor. Any such request must be directed to the entity that processed the payment.

Section 08

Payments; Taxes

All payments are due at the time of purchase unless otherwise specified by Care Solutions Training. By providing payment information, you authorize Care Solutions Training and its payment processors to charge the payment method provided for all applicable fees, taxes, and other charges. You are responsible for any applicable sales, use, value-added, withholding, or similar taxes associated with the purchase of any Product.

Section 09

Coursework Extensions

Subscriptions for courses offered by Care Solutions Training are available for one full year from the date of purchase. No extensions will be granted.

Section 10

Course Completion Daily Time Limitations

In accordance with best practices for adult learning and the requirements of various state registries, students may complete up to eight hours of training in a single day. After meeting this course-hour completion maximum, Users may view additional coursework, but they will not be able to access associated post-tests until the next calendar day.

Section 11

Changes to Courses

Care Solutions Training may make changes to the Site and the Products, including any courses, at any time and may add or remove courses at any time, in Care Solutions Training’s sole discretion. Care Solutions Training shall not be liable to Users for any changes to the available courses.

Section 12

Intellectual Property

All materials presented on or accessed through the Site — including website content, course descriptions, course content, downloadable resources, and images — are the property of Care Solutions Training or are used with permission from the license holder. Accessing the Site or purchasing Products does not provide or imply any User rights to or ownership of these materials.

Users may save or reproduce materials presented in Care Solutions Training courses or on the Site for their own use, but may not provide them to other parties or incorporate them into other trainings or materials, except where permission is expressly granted by Care Solutions Training in writing.

Subject to your compliance with these Terms and Conditions and payment of all course fees, Care Solutions Training grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the course materials solely for your individual, educational purposes for a period of one year from the date of purchase.

Section 13

Third-Party Materials

Care Solutions Training may allow Users to access content, products, or services offered by third parties through hyperlinks, API, or other tools. You are cautioned to read such websites’ terms and conditions and/or privacy policies before using them. Care Solutions Training has no control over such third-party websites and shall not be responsible or liable to anyone for such websites or any content, products, or services made available therein.

Section 14

Acceptable Use

By using the Site and the Products you agree not to:

• Make any unlawful communications, including threats of violence, obscenity, child pornography, or harassing communications
• Resell, repurpose, or redistribute any materials made available through the Site without our express written consent
• Share passwords or login information with any other person
• Impersonate any other person or entity or misrepresent your identity
• Attempt to alter or falsify any certificates, records, or other information regarding course completion
• Infringe the intellectual property rights of Care Solutions Training or any third party
• Interfere with or disrupt the Site or Products or otherwise interfere with Care Solutions Training’s systems and networks
• Engage in dishonest, misleading, or fraudulent conduct in connection with any course or assessment

Section 15

Indemnification

You agree to indemnify, defend, and hold Care Solutions Training and our officers, directors, partners, employees, and affiliates harmless from any liability, loss, claim, and expense, including reasonable attorney’s fees, related to your (a) violation of these Terms and Conditions, (b) violation of any law, and (c) use of the Site or the Products.

Disclaimer

THE INFORMATION ON THIS SITE IS PROVIDED ON AN “AS IS,” “AS AVAILABLE” BASIS. YOU AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK. CARE SOLUTIONS TRAINING DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY AND AVAILABILITY. TO THE EXTENT YOUR JURISDICTION DOES NOT ALLOW LIMITATIONS ON WARRANTIES, THIS LIMITATION MAY NOT APPLY TO YOU.

Section 17

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CARE SOLUTIONS TRAINING AND ITS AFFILIATES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, OWNERS, AGENTS AND REPRESENTATIVES (COLLECTIVELY, THE “CARE SOLUTIONS TRAINING PARTIES”) SHALL NOT BE LIABLE OR RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO THE SITE, SERVICES, YOUR SITE USE, OR ANY CONTENT PROVIDED IN THE SITE AND SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE CARE SOLUTIONS TRAINING PARTIES EXCEED THE GREATER OF (A) TOTAL AMOUNT PAID BY A USER TO CARE SOLUTIONS TRAINING FOR ALL PURCHASED PRODUCTS, OR (B) ONE HUNDRED DOLLARS ($100).

Anti-Bias Policy

Care Solutions Training provides equal opportunity and fair treatment to all students and applicants without regard to race, creed, color, sex, sexual orientation, national origin, religion, age, veteran status, or disability.

Section 19

Intended Audience

This Site is intended for use only by Users 18 years of age or older. If you are under the age of 18, please do not use the Site or provide any personal information about yourself to Care Solutions Training.

Section 20

Applicable Law

You agree that the laws of the State of Georgia, without regard to conflicts of laws provisions, will govern these Terms and any dispute that may arise between you and Care Solutions Training. Any claim or dispute related to these Terms and Conditions shall be brought in the federal or state courts of competent jurisdiction for Fulton County, Georgia, and you hereby submit to the personal jurisdiction thereof.

Sections 21 – 27

General Terms

Severability (21): If any provision of these Terms shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Waiver (22): The failure of Care Solutions Training to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Care Solutions Training.

Complete Terms; Modification (23): These Terms and Conditions constitute the complete understanding between you and Care Solutions Training and supersede all prior communications and proposals. Care Solutions Training reserves the right to modify these Terms at any time by posting updated Terms at the applicable address on the Site.

Force Majeure (24): Care Solutions Training will not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, labor disputes, internet or telecommunications failures, cyber incidents, governmental actions, epidemics, pandemics, or power outages.

Headings (25): Headings in these Terms are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section.

Assignment (26): Care Solutions Training shall have the right to assign these Terms to any person or entity, including any affiliates, subsidiaries, or successors in interest. You may not assign, in whole or part, these Terms to any person or entity.

Notices (27): Care Solutions Training may provide notices to you by email, through your account, through the Site, or by other reasonable means. You consent to receive electronic communications from Care Solutions Training.

Section 28

SMS Communications

By consenting to Care Solutions Training’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Care Solutions Training through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list.

Messages may include transactional messages (order updates, account alerts, course status reminders) and promotional messages (new course offerings, specials). There is no charge for the SMS/text messaging service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider.
